A federal high Court sitting in Abuja on Monday restrainds the Peoples Democratic Party PDP from susppending or expelling the Governor of Rivers state, NYESOM WIKE from the party.
Justics James Omotosho made it known following an ex-party motion filed by WIKE against the PDP and it top officials in a motion makerd FHC/ABJ/CS/139/2023 had sued the PDP, it’s national working committee (NWC) and it’s national executive committee (NEC). And others joined in the application dated and filed Feb 2 also included the national Chairman, Dr Iyorchia Ayu, the national secretary of PDP Sen Samuel Anyanwu and the INEC as 1st to 6 respondent respectively.
Govnor Wike is praying for an order directing all the parties to matiain status quo and saying all the actions in the matter relating to the threat to suspend or expel him by the 1sr to 5 respondent pending the herring of the originating motion.
Speaking further governor Wike also asked for an order of the court granting him leave to serve the motion on notice, and all other process of the court. In the suit on the 1st to 5 respondent by substituted means by pasting all of the said process at the PDP Secretariat.
After hearing Wike’s lawyer, Dr J Y Musa SAN, Justice Omotosho granted all the relief sought.
That all the parties in this suit shall maintain peace and shall not take any action or step or act that may make the outcome of the motion on notice dated and filed on Feb 2 2023 negatory and worthless.
That any act or step made so as to make the outcome of the motion on notice dated and filed on 2 Feb 2023 nugatory shall be a unllity.
The Judge, Consequently, adjourned the matter until Feb 14 for further hearing.
