A Federal High Court sitting in Enugu Thursday granted an exparte order restraining the All Progressives Congress, APC from recognizing Dr. Ben Nwoye as State chairman in the just concluded congresses of the party.
The Court also ordered that other members of the executive elected alongside Nwoye are also restrained from being recognized by the party pending the hearing of the Motion on Notice fixed for June 6, 2018.
The Court ordered that status quo be maintained pending the hearing of the motion on notice.
It further granted an order for substituted service of the Writ of Summons, the Motion on Notice for Injunction and all other processes connected with the suit on all the Defendants/Respondents by advertisement in any of the National dailies that is in circulation within Nigeria.
Presiding Judge A.M Liman also granted an order abridging the time within which the Defendants/Respondents are to file Counter Affidavit to the Plaintiffs Motion on Notice to 2 days and the Plaintiffs/Applicants time to file reply to 2 days.
Fielding questions from newsmen Deacon Okey Ogbodo who was elected after some party stalwarts staged a walk out, said he is the legitimately elected chairman and has already taking over the party secretariat.
He argued that the Congress that elected him was held on Saturday May 19, 2018 which was the scheduled date for State Congress arguing that any other Congress held on another date is null and void.
